BANTER EXPERIENCES PRIVACY POLICY

Your privacy and the security of your personal information are very important to us. This Privacy Policy describes how we collect, store, use and disclose Personally Identifiable Information (defined below) from users of the Platform. This Privacy Policy is governed by our Terms and Conditions located at www.justbanter.co.uk. All capitalized terms not defined herein are defined in the Terms and Conditions.

We may amend this Privacy Policy from time to time. We will post any changes to this Privacy Policy here so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone. Please refer back to this Privacy Policy on a regular basis. By using the Platform, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent that we will collect, store, use, and disclose your Personally Identifiable Information in the following ways. If you do not agree with any practices in this Privacy Policy, please do not access or use the Platform.

GENERAL

Please bear in mind that this Privacy Policy applies only to information collected by the Company via the Platform and Company Services. We are not responsible for (a) the privacy of any information you reveal in any of the presentations you create via or through the Platform, or (b) the privacy practices of businesses, websites and application that are operated or owned by third parties.

INFORMATION WE COLLECT ABOUT YOU

We collect two types of information: personally identifiable information and non-personally identifiable information.

Personally Identifiable Information. “Personally Identifiable Information” means any information that identifies you or can be used to identify or contact you. Such Personally Identifiable Information may include, but is not limited to, your name, email address, mailing address, telephone number, the main point of contact, and billing and credit/debit card information. We may request Personally Identifiable Information from you when you register for an Account on the Platform.

Non-Personally Identifiable Information. When you become a registered user of the Platform, we may also collect information that by itself cannot be used to identify or contact you, such as demographic information (such as age, profession or gender) ("Non-Personally Identifiable Information"). Non-Personally Identifiable Information may also include user IP addresses, browser types, domain names, and other anonymous statistical data involving the use of the Platform and Company Services. Non-Personally Identifiable Information is used to help us understand who uses the Platform and Company Services and to improve the Platform and Company Services.

WHERE AND WHEN INFORMATION ABOUT YOU IS COLLECTED

We may collect information (including information that is Personally Identifiable Information) from you when you register for an Account. We may also collect information from you in connection with, or through, Company Services. The following is a description of the areas and/or manners in which we primarily collect information about you:

Registering for an Account. If you are registering for a Client Account, we will ask you to (i) provide your full name, entity name (if you represent one), email address, a phone number, and mailing address and (ii) choose a username and password. If you are registering for a Supplier Account, we will ask you to (i) provide your full name, your email address, the name of the entity you represent, your phone number, entity’s address, full name of the main point of contact (if it is not you), and his/her email address and phone number, (ii) provide general information on the venue such as the name of the venue you operate, general rules and policies for using your venue, the venue’s address, its capacity, size, photos, facilities it has, amenities it offers, and whether it has different meeting spaces or not and (iii) choose a username and password.

Payment Processing. For payment processing purposes, we will collect your billing and payment information. Such information will not be shared with third parties.

Information Collected Via Technology. To make the Platform more useful to you, we may collect certain information about you, your mobile or desktop device and operating system via technologies (“Technology Data”). Like most companies, we may automatically gather the Technology Data and store it in log files each time you access our Platform or use the Company Services. Such Technology Data may include, but is not limited to, the type of device you use, your device ID, Internet Protocol (IP) address of the TCP connection for each authentication request, the date/time stamp for various Platform activities, and other similar diagnostic logs.

We may also use Cookies (as defined below) and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time you visit the Platform or use the Company Services and the information which you searched and which you viewed.

“Cookies” are tiny text files which identify your mobile device or computer to our server as a unique user when you visit certain pages of the Platform and they are stored by your Internet browser on your mobile device’s or computer's hard drive. Cookies can be used to (i) recognize your Internet Protocol (IP) address, and/or (ii) help you save you time (a) while you are visiting/using the Platform, or (b) when you want to enter the Platform.

Your browser can be set to not accept cookies, but if you elect to do so, some parts of the Platform or the Company Services may not work properly function on your mobile or desktop device.

Our website uses Google Analytics cookies. Cookies are used for Personalized advertising. Information collected by Google Analytics cookies will be transmitted to and stored by Google on servers in the United States of America in accordance with its privacy practices. You can access Google's privacy policy at Google’s Privacy & Terms site. You can completely disable Google Analytics for your browser by visiting the following link https://tools.google.com/dlpage/gaoptout.

Information from Other Sources. From time to time we may also collect information about you through (i) other communications with you (e.g., email), (ii) your feedback, and (iii) surveys.

Feedback. If you provide the Company with any feedback or suggestions (“Feedback”), you hereby assign to the Company all rights in the Feedback and agree that the Company shall have the right to use such Feedback and related information in any manner it deems appropriate. We will treat any Feedback you provide to us as non-confidential and non-proprietary. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary.

HOW WE USE YOUR PERSONAL INFORMATION

Generally, we collect, store, use and disclose information to enable us to (i) improve your experience when you use the Platform or Company Services, (ii) create your Account, (iii) identify you as a user, (iv) respond to your inquiries and emails, (v) send you administrative and service related communications, and (vi) send you newsletters, surveys, offers, and other promotional materials. Except as set out in this Privacy Policy, your information will not be used for any other purpose without informing you first by updating this Privacy Policy.

Except for the limited disclosures described in this Privacy Policy, we do not sell customer lists and we will endeavor to keep your Personally Identifiable Information private.

Non-Personally Identifiable Information and anonymous aggregate statistics that do not personally identify a user will be kept and used by us for various purposes including analysis and reporting of usage patterns. We reserve the right to use and disclose Non-Personally Identifiable Information and anonymous aggregate statistics for any purpose and to any third party in our sole discretion.

Sharing Your Information with Suppliers. A Client’s Personally Identifiable Information will be shared with those Suppliers that the Client enters into a Contract with on the Platform. This is done so that Suppliers could contact Clients, when needed, for the sake of providing products and services under a Contract.

Service Providers. We may engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, payment processing and database storage and management. We may share your Personally Identifiable Information with these third parties, but only to the extent necessary to perform these functions and get such services.

Business Transfers. We may sell, transfer or otherwise share some or all of our assets, including your Personally Identifiable Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

Disclosures for Legal Purposes. We may disclose your Personally Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of Platform users or the public, or (iv) protect us from legal liability.

LINKS TO OTHER WEBSITES

The Platform may contain links to third-party websites. The fact that our Platform may contain links to third-party websites, it shall not be construed as an endorsement, authorization or representation of our affiliation with those third parties. We do not exercise control over third-party websites either. These other websites may place their own cookies or other files on your computer, collect data or solicit Personally Identifiable Information from you. We encourage you to read the privacy policies or statements of the other websites you visit.                       

SECURITY

The security of your information is important to us. We use commercially reasonable efforts to store and maintain your information in a secure environment and have implemented commercially reasonable procedures designed to limit unauthorized access, use or disclosure of your information.

You are also responsible for helping us protect the security of your Personally Identifiable Information. For instance, never give out your password, and remember to log out of your Account when you are finished using the Platform. Despite these measures, you should know that we cannot fully eliminate security risks associated with your information.

MINORS POLICY

The age of majority depends upon jurisdiction and application, but it is generally set at eighteen (18). Minors or the underaged may not use the Platform and the Company Services. Consequently, we do not knowingly collect or solicit Personally Identifiable Information from anyone under the age of 18 or knowingly allow such persons to open an Account on the Platform. If you are under 18, please do not attempt to open any such Account or send any information about yourself to us, including your name, address, telephone number, or email address.

In the event that we learn that we have collected Personally Identifiable Information from an individual under the age of 18, we will delete that information as quickly as possible. If you believe that we might have any information from or about an individual under the age of 18, please contact us at enquire@justbanter.co.uk. 

OPT OUT

When you receive newsletters, surveys, offers, and other promotional materials from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe link provided in the e-mail you receive or by contacting us directly at enquire@justbanter.co.uk. Despite your indicated e-mail preferences, we may send you service related communication, including notices of any updates to our Terms of Service or Privacy Policy.
